fixedbar and Problems in IE without doctype

I have a specific problem with a fixed bar.
I want to use this fixedbar but I shouldn't use <!doctype>
This bar in IE has problems, for example bar by scroll is not fixed and move or size of tooltips changed.

Can you help me?

Er, have you tried asking the author of the tool? Besides, why can't you use a doctype[^] declaration?

No Exceptionally, I don't have the right for using of <doctype> in this Project!

In fact, my project owner don't let me to use of <doctype> | w3c
