Thanks for your input Andy! However I got help and found a solution where if won't be necessary.

I tried:
where (env.Element(ns + "docs")) != null

This does however not stop the select from happening. Any suggestion of how a working 'where' would look like in this case?

Thanks for your input, you might be right. I certainly have to compare the two setups in order to really know. Regarding writing the SOAP envelopes to disk, would I/O be lower if written to a XML column in the db instead you think?
