Excel API: Workbook Open (name conflict)

When I open my Sheet via Code (excel api), a Dialog popped up to solve name conflicts.
But when I open the File with Excel, the dialog dosen't popped up.

The reason for the conflict is an old autofilter range name.
Temp Solution: I delete the range names of the autofilter.

My Question:
Can I open the Sheet without showing the conflict dialog and why is there a conflict?
