The ruling is correct. Now if the Dept of Labor had done this the ruling would have gone the other way as this is in their Congressionally mandated function. The problem is that it was the wrong department banning non-compete clauses.

In Italy we have them. They are regulated but we have them. Main regulation points:
* They must be compensated beyond the normal pay;
* They are null if the compensation is lower than 15% of yearly wage;
* They must be constrained both in duration and geographical area and cannot exceed 5 years anyway;
* The compensation must reflect the heaviness of constraints (the wider / longer, the more they have to be compensated. No 15% for a worldwide ban for 5 years);
* They apply only to direct competitors. If someone moves from automotive firmware to aerospace firmware there is no sanction;
* The sanction to the employee is fixed at 2 times the cumulative amount received during the employment time.
